Terms of Service
These Terms of Service ("Terms") are a binding agreement between you ("you," "User") and DaFonte Labs LLC, a Connecticut limited liability company based in Connecticut, United States("Fanal," "we," "us"). They govern your access to and use of the Fanal mobile application, related software, and services (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Beta / Pre-Release Notice
The Service is provided as a pre-release beta for evaluation. It may contain errors, may be incomplete, and may change, be suspended, or be discontinued at any time without notice or liability. Features described in marketing or documentation may not be available and are not promised. The Service is provided "AS IS" and "AS AVAILABLE."
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. By using the Service you represent that you meet these requirements.
3. Scope of Service
Fanal records your device's GPS (and related sensor-derived data) during drives you choose, and may capture optional dashcam video. The tamper-evident, on-device record applies to drives the Service supports. Posted-limit lookups and camera/plate-reader map pins are drive-oriented reference features; Fanal does not provide approach warnings or spoken alerts.
4. SAFETY — YOUR RESPONSIBILITY
READ THIS SECTION CAREFULLY.
The Service is an informational and record-keeping tool. It is not a navigation, fitness, medical, safety, or emergency device and must never be relied upon to prevent accidents, injury, or death, or as a substitute for emergency services.
- Do not interact with, view, configure, or manipulate the Service while operating a vehicle. Set up the app before you drive.
- You are solely responsible for your surroundings and safety while driving, and for complying with all applicable traffic laws, private-property and trespass rules, and local regulations.
- You must always obey posted speed limits, signals, and the instructions of law enforcement, regardless of anything the Service displays or fails to display.
- The Service does not authorize, encourage, or assist unlawful driving or unlawful conduct of any kind. It is not a radar or laser detector and is not intended to help evade law enforcement.
5. No Guarantee of Map Context, Accuracy, or Detection
Camera, plate-reader, speed-limit, school-zone, and other map context shown in the Service is approximate, incomplete, and may be wrong, delayed, mislocated, or entirely absent. It is derived from third-party and crowdsourced data (including OpenStreetMap and public agency sources) that we do not control and do not guarantee. Map pins are reference only; the Service does not warn or speak as you approach.
GPS location, speed, distance, and timing readings are estimates subject to signal, hardware, and environmental error and may be materially inaccurate.
You must not rely on the Service to identify hazards, enforcement, speed limits, routes, or road conditions. Independent verification is your responsibility.
6. No Legal Advice; No Guarantee of Evidentiary Value
Fanal is not a law firm and provides no legal advice. "Evidence Reports," saved moments, exports, records-request letters, hash verification, timestamps, notarization/anchoring features, and similar outputs are informational tools only. These disclaimers apply to driving records and any other activity types the Service records.
We make no representation or warranty that any Service output is accurate, complete, authenticated, tamper-proof, admissible in any proceeding, or sufficient to support or defend any claim, ticket, dispute, or other matter. Admissibility and evidentiary weight are determined solely by courts and applicable rules of evidence.
For any legal matter, consult a licensed attorney. Your reliance on any Service output is at your own risk.
7. License
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for your own non-commercial purposes. We reserve all rights not expressly granted.
8. Acceptable Use
You agree not to:
- use the Service unlawfully or to facilitate unlawful conduct;
- reverse engineer, decompile, or attempt to derive source code except where such restriction is prohibited by law;
- interfere with, disrupt, probe, or circumvent security of the Service;
- resell, rent, or commercially exploit the Service without our written consent;
- misrepresent Service outputs as authenticated or court-verified; or
- use the Service in any manner that distracts you or others from safe driving.
9. Your Data and Content
Activity records you create (including drives) are stored on your device and are controlled by you. You are responsible for your data, including backups you configure and any cloud storage you connect ("bring-your-own-cloud").
You retain ownership of your activity data. You grant us only the limited rights necessary to operate features you enable on your device. See our Privacy Policy for details.
If you connect third-party storage, you are responsible for that provider's terms, security, and availability. We are not responsible for data stored outside the Service.
10. Third-Party Services and Data
The Service integrates or interoperates with third parties (e.g., Apple, Mapbox, OpenStreetMap, public-agency data sources, and optional diagnostics providers). We do not control and are not responsible for third-party services, data, availability, or terms, and your use of them may be governed by their own agreements.
11. Intellectual Property
The Service, including all software, designs, trademarks, and content (excluding your activity data and third-party data), is owned by Fanal or its licensors and protected by law. "Fanal" and related marks may not be used without our written permission.
12. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY DATA WILL BE ACCURATE, PRESERVED, OR RECOVERABLE. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FANAL OR ITS OFFICERS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR PERSONAL INJURY, DEATH, PROPERTY DAMAGE, FINES, PENALTIES, OR LEGAL COSTS, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
14. Assumption of Risk
You acknowledge that driving can be dangerous, and that you assume all risk arising from your operation of a vehicle and your use of the Service, including reliance on any map context, data, or output.
15. Indemnification
You will indemnify, defend, and hold harmless Fanal and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your driving, your violation of law, your violation of these Terms, or your infringement of any third-party right.
16. Dispute Resolution; Arbitration; Class Waiver
To the extent permitted by law, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable consumer rules, seated in Fairfield County, Connecticut, and you and Fanal waive any right to a jury trial or to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing hello@fanal.io.
Where mandatory local law prohibits or restricts arbitration or class waivers (including for consumers in the EU/UK and some US states), that local law controls, and disputes may be brought in a court of competent jurisdiction instead.
This section is a working draft for beta distribution and should be reviewed by counsel before relying on it for enforceability in every jurisdiction.
17. Governing Law
These Terms are governed by the laws of Connecticut, United States, without regard to conflict-of-laws rules, except where mandatory local consumer-protection law applies to you.
18. Termination
We may suspend or terminate your access at any time, with or without cause, especially during beta. You may stop using the Service at any time and delete your data on-device. Sections that by their nature should survive (including 4–6 and 9–17) survive termination.
19. Changes to These Terms
We may modify these Terms. Material changes will be indicated by updating the "Last updated" date and, where appropriate, in-app notice. Continued use after changes constitutes acceptance. The app stores the accepted Terms version on your device.
20. Apple/Google App Store Terms
If you obtained the Service through a third-party app store, that store's terms also apply, and where required, the store and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them.
21. Miscellaneous
These Terms, with the Privacy Policy, are the entire agreement. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may.
